The New Criminal Law Bharatiya Nagarik Suraksha Sanhita 2024 taking effect from tomorrow, July 1, 2024. These laws repeal and replace the Indian Penal Code, the Code of Criminal Procedure, and the Indian Evidence Act respectively.

Under Bharatiya Nagrik Suraksha Sanhita (BNSS) has 531 sections (in place of 484 sections of CrPC). A total of 177 provisions have been changed in the Sanhita and nine new sections as well as 39 new sub-sections have been added to it. The act has added 44 new provisions and clarifications.

Bharatiya Nagarik Suraksha Sanhita 2024 Highlights

  • FIRs can now be registered via electronic communication. It will be taken on record on being signed within three days, by the person giving such information.
  • Police must register an FIR where information regarding the commission of a cognizable offence is received, irrespective of whether it has jurisdiction or not (‘Zero FIR’).
  • Section 107 of BNSS gives Magistrate powers to attach property identified as ‘proceeds of crime’.
  • No significant improvements have been made with respect to the rights of arrestee except that now an arrestee can inform any person of the fact of his arrest, other than just a friend and relative, which could also include his lawyer.
